Phonographic Performance Limited (PPL) filed 44 Infringement Suits in 2023, in keeping with its stance of safeguarding the rights of over 400 music labels and their catalogue of 7 million songs. The legal action, spanning the various courts, underscores PPL’s commitment to curb unauthorised communication of sound recordings.
PPL India, which monetises sound recording rights for music labels, has an on-ground team of more than 100 staff who monitor establishments, ensuring compliance with licensing requirements. In addition to physical monitoring, PPL tracks music usage on social media platforms and event listing sites, enabling swift identification of copyright infringements.
The Delhi High Court, in recent judgments, targeted the unauthorised use of copyrighted sound recordings by establishments such as One8 Commune (owned by Virat Kohli), Tim Hortons, Aptronix, Unicorn, Gola Sizzler, Str8up Hospitality (brands like Duty Free, Sassy Oscar, Too Indian, etc.), and others across India.
PPL India expressed its gratitude to the Delhi High Court for upholding the rights of copyright holders and ensuring fair compensation for creators. “To safeguard the creative efforts of music labels, PPL adopts a multifaceted approach, from proactive monitoring to legal interventions,” the company said in a release.
PPL’s enforcement mechanism includes issuing introduction and reminder letters, as well as legal recourse, including police complaints and infringement suits under Section 55 of the Copyright Act 1957. Moreover, PPL actively collaborates with industry associations and venues, participating in sponsorships and brand awareness programs that foster a culture of legal music usage.
