New Delhi: The Delhi High Court recently granted relief to INOX India (INOX), ruling in favor of the company’s appeal against specific remarks included in its copyright registration certificate issued by the Registrar of Copyrights. The Court’s decision followed INOX’s challenge to a clause that imposed certain restrictions on its artistic work, specifically related to the use of its technical drawings.
Khaitan & Co. represented INOX in this matter. The legal team, led by Partners Smriti Yadav and Nirupam Lodha, along with Principal Associate Dhiren Karania, Senior Associate Gautam Wadhwa, and Associate Vanshika Thapliyal, successfully argued INOX’s case. Senior Advocate Chander M. Lall appeared on behalf of INOX during the proceedings.
The appeal stemmed from the inclusion of a remark on the copyright registration certificate stating that the copyright in the artistic work would cease if the work were applied to an article more than 50 times. INOX contended that this restriction was unjustified, as the work in question consisted of technical drawings, which should not be subject to limitations under the Designs Act, 2000. INOX argued that these remarks were imposed without proper justification or legal basis.
During the proceedings before Hon’ble Justice Mini Pushkarna, the Registrar of Copyrights acknowledged the issue and agreed to amend the certificate. The Registrar committed to issuing a corrected certificate within four weeks, removing the contested remarks. The Registrar’s counsel also informed the Court of ongoing efforts to update the online portal and ensure similar issues do not arise in the future.
The Court took note of these developments and disposed of the appeal, granting INOX the relief it sought.
