According to media reports, FMCG brand Dabur has begun contempt proceedings against Marico and its Directors before Delhi High Court. Dabur has initiated the legal action as Marico has failed to adhere to the court’s order to change its honey packaging, which Dabur claimed was similar to theirs.
The issues started last year when Marico Ltd launched Saffola Honey. Dabur filed a case in the Delhi High Court alleging that Marico had imitated the shape of the bottle, its yellow cap, dome-shaped label, usage of honeycombs on the label, including other similarities, as per the court documents.
In an interim order by Delhi HC in July 2020, the court said that an overall comparison of the two products would prima-facie show a similarity confusing the buyer’s minds, even though the trade name Saffola is prominently noted on the bottle.
The case has been listed for hearing on July 14, 2021.
