Kolkata: SAJ Food Products renowned for the ‘BISK FARM’ brand, announced that the Calcutta High Court granted an injunction against Parle Biscuits for selling a new biscuit product named “TOP GOLD STAR.”
In 2005, Bisk Farm used “TOP GOLD” for a biscuit, obtaining trademark protection. Only SAJ had prior rights to the mark. Parle later introduced a similar product as “TOP GOLD STAR.”
Bisk Farm claims to be the original user of the mark TOP GOLD in Class 30. Parle’s use of “TOP GOLD STAR” is seen as infringing on Bisk Farm’s mark. Bisk Farm argues that this constitutes passing off and has sought a court order to stop Parle from using the “TOP GOLD STAR” mark.
On July 19, 2024, Hon’ble Justice Krishna Rao issued a stay order preventing Parle from selling or marketing their product under the “TOP GOLD STAR” brand name until August 27, 2024.

We are determined to protect our intellectual property rights and brand integrity which has been carefully built over two decades by our late founder Mr K.D.Paul. We are thankful to the honourable court for issuing an ex-parte protective order against this action of trademark infringement by Parle.”
